Update:Compliance with District Court Order Regarding Designation of TPS Haiti

On July 1, 2025, DHS terminated the designation of Haiti for Temporary Protected Status (TPS). Haiti’s TPS designation and related benefits were slated to terminate on Sept. 2, 2025.  However, on July 15, 2025, the U.S. District Court for the Eastern District of New York issued a final judgement in Haitian Evangelical Clergy Ass’n v. Trump, No. 25-cv-1464, that that makes the effective date of any termination no earlier than Feb. 3, 2026.

Creating an E-Verify Case

After a new employee has completed Form I-9, Employment Eligibility Verification, create a case in E-Verify for this employee. Enter the EAD document number you entered on Form I-9, as well as the expiration date of Feb. 3, 2026.

USCIS will not provide updated EADs with the amended Feb. 3, 2026, expiration date. You should correct previously completed Forms I-9 for each employee that previously presented an EAD with a Card Expires date of Feb. 3, 2026; Sept. 2, 2025; Aug. 3, 2025; Aug. 3, 2024; June 30, 2024; Feb. 3, 2023; Dec. 31, 2022; Oct. 4, 2021; Jan. 4, 2021; Jan. 2, 2020; July 22, 2019; Jan. 22, 2018; and July 22, 2017, to include the amended expiration date of Feb. 3, 2026. In the Additional Information field in Section 2 of the employee’s Form I-9, enter the amended Feb. 3, 2026, expiration date and initial and date the correction. You must reverify these employees before they start work on Feb. 4, 2026.
