If my employer did not retain a copy of the required photo match document during my verification, can they request the document now?

Yes. They should request the original photo document you presented, copy the front and back of the document (in the case of a U.S. passport, copy the ID and barcode pages), and retain it with your Form I-9.

E-Verify participants must retain a photocopy of the following documents with an employee’s Form I-9:

  • U.S. passport
  • U.S. passport card
  • Form I-551, Permanent Resident Card
  • Form I-766, Employment Authorization Document
